Terms of Service
1. Who these terms cover
These terms govern the PorThorOS website, free tools and business software provided by FGC Co., Ltd. An individual accepting a business subscription must be authorized to act for that business. A paid subscription requires an accepted order or service agreement identifying the customer and purchased service; viewing this website alone does not create a paid subscription.
2. Service scope and compliance
PorThorOS provides point-of-sale, inventory, staff access and record-preparation tools. Guides, form generators and compliance features support your work but do not constitute legal or medical advice, a licence, a prescription, or a guarantee that an authority will accept a report. Your business must verify records, obtain required licences and clinical authorizations, and meet its own filing and retention duties.
3. Accounts and acceptable use
Provide accurate account information, protect credentials and grant staff only appropriate access. Notify us promptly of suspected unauthorized access. Do not access another business’s data, bypass security, introduce malicious code, infringe rights, upload data without a lawful basis, or use the service for unlawful activity.
4. Plans, fees and renewal
Before paid service begins, the accepted order must state the scope, price, currency, taxes, billing period and payment terms. Public pricing is informational until confirmed in that order. Automatic renewal applies only if expressly agreed. Any price change applies only after notice and acceptance through a new or renewed order, not retrospectively to an agreed paid period.
5. Cancellation, billing disputes and refunds
An authorized account contact may request cancellation or query a charge at hello@porthoros.com. Cancellation takes effect at the end of the agreed current service period unless the order or applicable law provides otherwise; stopping use alone does not cancel an agreed payment obligation. Refund eligibility follows the accepted order and applicable law. No blanket exclusion of statutory refund rights applies. We will review disputed or incorrect charges and communicate the outcome.
6. Your data and our software
You retain your rights in the records you submit and grant FGC permission to process them only as necessary to provide and protect the service and meet legal duties. FGC and its licensors retain rights in the software, branding and site materials. Your subscription grants use of the agreed service, not ownership of its software. The Privacy Policy explains FGC’s own processing; the Data Processing Agreement governs processing on your business’s behalf when incorporated into your accepted agreement.
7. Availability, support and third parties
Maintenance, faults and third-party outages can interrupt service. Any uptime commitment, support response time or service credit must be expressly stated in your order; this page does not promise uninterrupted availability. Keep independent copies of legally required records. Payment providers, messaging services and clinical services may have separate terms, and you remain responsible for authorizing integrations.
8. Suspension, termination and records
We may restrict access where reasonably necessary to address security risks, unlawful use, material breach or overdue agreed fees. Where practicable, we will give notice and an opportunity to resolve the issue; urgent protective action may occur first. Before account closure, contact us to arrange retrieval of your records and confirm the export and deletion process. Closure does not itself erase records subject to a lawful retention duty or end outstanding lawful payment obligations.
9. Responsibility and liability
We will provide the service with reasonable care. To the extent permitted by law, FGC excludes indirect or consequential losses and losses attributable to inaccurate customer data, unauthorized customer actions or third-party services outside FGC’s control. Nothing excludes liability or rights that cannot lawfully be excluded, or FGC’s statutory data-protection duties. Any additional agreed liability allocation must be set out in the service agreement.
10. Changes, governing law and contact
Thai law governs these terms, subject to mandatory rights under applicable law. Material contractual changes will be notified to affected customers and take effect through the applicable agreement process, not merely by replacing this page. Contact hello@porthoros.com or the registered address above for support, cancellation or formal notices. Thai and English versions are available; any language-precedence rule must be agreed in your order. If wording differs, contact us for clarification.
